Privacy Notice - AZANIA DRIVING INSTITUTE

Azania Driving Institute ("ADI", "we", "us", or "our") is committed to protecting your privacy and handling your personal information responsibly. As a driving school based in Stellenbosch, South Africa, we operate in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). 

This Privacy Notice explains how we collect, use, disclose, and protect personal information when you interact with our website (https://azaniadriving.co.za/), engage with our services, or contact us. By using our website or services, you consent to the practices described in this Notice.

1.1. Information You Provide

Contact and Identification Details: Name, email address, phone number, ID number or passport details (required for learner's licence applications and compliance with the National Road Traffic Act 93 of 1996).

Training-Related Information: Driving history, learner's licence details, medical fitness certificates, payment information (e.g., bank details for course fees), and feedback on training sessions.

Enquiries and Bookings: Details submitted via email, phone, or any future online forms (e.g., course registration, phase selection for foundational, simulator, or on-road training).

 

1.2. Information Collected Automatically

Website Usage Data: IP address, browser type, device information, pages visited, time spent on site, and referral sources (via cookies or analytics tools, if implemented).

No Sensitive Data: We do not collect special categories of personal information (e.g., racial or ethnic origin, health data beyond what's legally required for driving licences) unless explicitly provided for licensing purposes.

We do not collect information from children under 18 without parental consent.

 

2. How We Use Your Information

We process personal information only for lawful purposes, such as fulfilling contracts, complying with legal obligations, or pursuing our legitimate interests as a service provider. 

Specific uses include:

Service Delivery: To register you for driving courses (e.g., Phase 1 foundational training, Phase 2 simulator sessions, Phase 3 on-road lessons), process payments, schedule sessions, and issue certificates.

Communication: To respond to enquiries, send booking confirmations, training updates, or promotional materials (with your consent where required).

Compliance and Safety: To verify eligibility for learner's or driver's licences, report to the Department of Transport or licensing authorities, and ensure road safety standards.

Improvement: To analyse usage patterns for enhancing our website and training programs (e.g., aggregated, anonymised data).

Marketing: To inform you about new courses or bulk intake options for institutions, but only with your opt-in consent.

We will not use your information for automated decision-making that significantly affects you without your consent.

Legal and Regulatory Bodies: The Department of Transport, South African Police Service (for verification), or the Information Regulator (in case of complaints or breaches).

Business Transfers: In the event of a merger, acquisition, or sale of assets.

No International Transfers: Currently, we do not transfer data outside South Africa. If this changes, we will ensure equivalent protections (e.g., binding agreements) are in place.

All recipients are bound by confidentiality obligations and POPIA compliance.

 

5. Data Security

We implement reasonable technical and organisational measures to protect your information against unauthorised access, loss, alteration, or disclosure, including:

  • Secure servers and encryption for sensitive data (e.g., payment details).

Despite these measures, no system is completely secure. In the event of a security incident, we will notify the Information Regulator and affected individuals as required by POPIA (as soon as reasonably possible, typically within 72 hours).

Access: Request confirmation of whether we hold your information and a copy of it (subject to PAIA procedures and fees).

Correction: Update inaccurate or incomplete data.

Deletion: Request removal (unless we are legally required to retain it, e.g., for 5 years under tax laws).

Objection/Restriction: Object to processing based on legitimate interests or restrict it in certain cases.

Portability: Receive your data in a structured, electronic format.

Withdraw Consent: At any time, where processing relies on consent.

Lodge a Complaint: With the Information Regulator (POPIAComplaints@inforegulator.org.za or +27 10 023 5200).

We aim to respond within 30 days. If unsatisfied, you may approach the courts.

 

8. Retention of Information

We retain personal information only as long as necessary:

Training records: 5–7 years (for legal and auditing purposes).

Enquiry data: 1 year after resolution, unless a service contract is formed.

Website logs: 12 months.

Thereafter, data is securely deleted or anonymised.

 

9. Changes to This Notice

We may update this Notice to reflect changes in our practices or law. The updated version will be posted on our website with the new effective date. Significant changes will be notified via email (where we have your contact details).

 

10. Governing Law

This Notice is governed by South African law, including POPIA.
